Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in connection with Sakra (Bariyarpur O.P) P.S. Case no. 374 of 2021 registered for the offence punishable under sections 272, 273 of the Indian Penal Code read with section 30(a) of Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 28.7.2021, is person with clean antecedent and charge sheet has been submitted. Allegation is
Patna High Court CR. MISC. No.52950 of 2021(2) dt.24-12-2021 2/2 recovery of 27.720 liters of liquor from dicky of the motorcycle. Learned counsel submits that petitioner is not owner of the motorcycle and as such was not aware what was being carried in the motorcycle.
Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody, is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 1,000/- (one thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in Sakra (Bariyarpur O.P) P.S. Case no. 374 of 2021.
