2. The petitioner has preferred this application for grant of regular bail in connection with Raghopur P.S. Case No. 71 of 2024 dated 03.03.2024 registered for the offences punishable under Section 25(1-B)a and 26 of the Arms Act.

3. As per the prosecution case, one country-made pistol and five live cartridges were recovered from the dicky of the petitioner's motorcycle which was being driven by the petitioner at the time of alleged occurrence.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the

Patna High Court CR. MISC. No.47861 of 2024(2) dt.31-07-2024 2/2 petitioner. The allegation against the petitioner is general and omnibus in nature. The petitioner has no concern with the alleged recovery. It is further submitted that the investigation related to the petitioner has been completed and charge-sheet submitted. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.03.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur in connection with Raghopur P.S. Case No. 71 of 2024.

7. The application stands allowed.
