The petitioner seeks bail in a case registered for offences under Sections 30 (A) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 32 litres of country made liquor was recovered from the bag kept on motorcycle which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 10.07.2017.

Considering the facts and the circumstances of

Patna High Court Cr.Misc. No.53359 of 2017(2) dt.09-11-2017 2/2 the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, West Champaran at Bettiah in connection with Dhanha P.S. Case No. 51 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
