JUSTICE MADHURESH PRASAD ORAL ORDER 05-08-2019 The petitioner has been denied lst time bound promotion & ACP by the authorities on consideration that while working in the work charge establishment he got a progression on account of his posting as Gate Sahayak from the earlier post of Khalasi.

Counsel for the petitioner submits that in light of the decision of this Court passed in CWJC No. 9254 of 2006 the claim of the petitioner was required to be considered as per the provisions contained in circular of the State Government dated 27.3.1987.

Patna High Court CWJC No.14051 of 2011(6) dt.05-08-2019 2/2 From perusal of the counter affidavit also it is apparent that the claim of the petitioner has not been considered in light of circular dated 27.3.1987.

The writ petition is therefore disposed of with liberty to the petitioner to place his claim giving details of period rendered in work charge establishment before respondent No. 2, the Chief Engineer, Water Resources Department, Dehri, Rohtas. The claim should be submitted within four weeks so as to facilitate consideration.

The respondent authorities will be obliged to consider claim of the petitioner in light of the observations hereinabove within a period of eight weeks thereafter. Dues found admissible on account of time bound promotion & ACP and consequential benefits thereafter as per admissibility should be paid to the petitioner within a period of four weeks thereafter. The writ petition is disposed of.
