The petitioner apprehends his arrest in connection with Mahila P.S. Case No.21 of 2015 for the offences punishable under sections 352, 370 and 366/34 of the Indian Penal Code and sections 4/6 of the POCSO (Prevention of Children from Sexual Offences) Act.
The copy of the FIR is placed at Annexure-1 and the petitioner is charged with forceful marriage with the victim girl who is underage.
Although Mr. Pramod Kumar Singh, learned counsel appearing for the petitioner seeks to draw the advantage from the requisition filed by the investigating officer seeking arrest of the petitioner on grounds of dissimilarity in name but in my
Patna High Court Cr.Misc. No.52464 of 2015 (2) dt.14-12-2015 opinion considering the statement of the victim girl recorded under section 164 of the Code of Criminal Procedure as well as her statement in the FIR this objection is unsustainable at the present stage.
This application is accordingly disposed of with direction to the petitioner to surrender before the court below and seek regular bail and any such application being filed shall be considered and disposed of by the court below on its own merits without being prejudiced by this order.
