JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Nathnagar PS case no. 442 of 2017 for the offences punishable under Section 153(A)(2), 295, 120(B) of Indian Penal Code. The allegation against unknown accused persons is regarding defacing the statue of Tunni Rakkchasi. It has been further alleged that in the CCTV footage, four persons were identified however, no details of the same are available. The learned counsel for the petitioner submits that the petitioner has been arrested merely on the basis of suspicion although there is no material on record to connect him with the alleged occurrence. It is further submitted that the petitioner has clean antecedent and he is languishing in custody since 22.08.2017.

No.49916 of 2017 (2) dt.17-10-2017 2/2 In the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar PS case no. 442 of 2017.
