Petitioner, already in custody, seeks bail in connection with Keoti P.S. Case No.84 of 2017, registered under Sections 394 and 364 of the Indian Penal Code.

Allegation in brief is that in the midnight the informant was kidnapped and the accused persons including the petitioner looted all the articles. Subsequently police apprehended the petitioner and on his confessional statement looted articles were recovered from one of his rooms.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated by the local S.H.O. as on his birthday, he made demand of chicken and the petitioner could not provide the same.

No.57564 of 2017 (2) dt.12-12-2017 2 /2 Having considered the nature of allegation and the recovery of looted articles after confessional statement of the petitioner, the prayer of bail of the petitioner stands rejected in connection with Keoti P.S. Case No.84 of 2017, pending in the court of learned A.C.J.M., VIIth, Darbhanga with a direction to the trial court to expedite the trial and preferably conclude the same within 11⁄2 years after framing of the charge. Let a copy of this order be sent to the Superintendent of Police, Darbhanga to ensure production of the prosecution witnesses before the trial court in order to conclude the trial within the stipulated period.
