Petitioner seeks bail in connection with Rahui (Bhaganbigha) P.S. Case No. 273 of 2017 for offences punishable under Sections 413, 414 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that during patrolling they intercepted a truck which was driven rashly. The driver and the owner were apprehended and the petitioner along with the owner did not produce any paper regard to the goods carried.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and he was
Patna High Court Cr.Misc. No.57174 of 2017 (2) dt.05-12-2017 2/2 just a driver of the truck and was not in-charge/owner of the materials carried in the truck. He submits that he is languishing in judicial custody since 04.10.2017.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Rahui (Bhaganbigha) P.S.
