The petitioner seeks bail in anticipation of his arrest in connection with Laheriasarai P.S. Case No. 429 of 2019, instituted for the offences under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. Though there is an accusation in the F.I.R. of the petitioner along with his brother and mother of assaulting the informant when he had gone to his house for realization

No.39657 of 2020(3) dt.12-07-2021 2/3 of rent from his father, who is his tenant but learned counsel for the petitioner has submitted that there is a counter version of the occurrence also. The informant had come to the house of the petitioner in a drunken state and had indulged in vandalism. Precisely for this reason, the mother of the petitioner had to file a case vide Laheriasarai P.S. Case No. 428 of 2019.

The parents of the petitioner have been injured in the occurrence.

Though the informant has received grievous injury but considering the background facts and the circumstances which reflect that there was some dispute between the parties with respect to realization of rent and for the informant having shown drunken behaviour, this Court is inclined to confirm the provisional bail granted to the petitioner.

While saying so this Court has also taken note of the fact that the petitioner does not have criminal antecedent.

For the reasons afore-stated, provisional bail

Patna High Court CR. MISC. No.39657 of 2020(3) dt.12-07-2021 3/3 granted to the petitioner vide order dated 07.06.2021 is hereby confirmed.

The petitioner shall remain on the same bail bonds. The application stands disposed of.
