2. The petitioners apprehend their arrest in a case registered for the offence under Section 498(A) and 328 of the Indian Penal Code.

3. As per F.I.R., on 19.04.2006, sister of the informant was married with co-accused Satdeo Chaudhary and it is alleged that after the marriage, due to family feud, the in-laws members of his sister always used to assault her and lastly, on 23.11.2023, the accused persons forcibly poisoned sister of informant, but anyhow she could be saved.

4. Petitioners are nephew of the victim and have been falsely implicated in this case. Thrust of the accusation is

Patna High Court CR. MISC. No.47850 of 2024(4) dt.26-10-2024 2/2 against husband of the victim, who has already been granted regular bail by the Court below on condition to give Rs. 6,000/- (six thousand) per month to the victim, as maintenance. Petitioners are separate in mess & property and have got no concern with the family affairs of victim and her husband.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of petitioners.

However, considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur, Ara in connection with Udwant Nagar P.S. Case No. 485 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
