====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in POCSO Case No. 21 of 2018 arising out of Lakhisarai (Mahila) P.S. Case No. 10 of 2018 instituted for the offence under Sections 323, 341, 376, 448/34 of the Indian Penal Code and Section 6 of POCSO Act. Counsel for the petitioner submits that instant case has been lodged on account of family dispute. In the written report it is alleged that petitioner who is elder brother of father of the informant has committed illegal act with the informant.

From the First Information Report it appears that occurrence is said to have taken place on 13.4.2018 and First Information Report has been lodged on 28.4.2018 i.e. after delay of 15 days.

Patna High Court Cr.Misc. No.67757 of 2018(3) dt.27-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1st, Lakhisarai, in connection with POCSO Case No. 21 of 2018 arising out of Lakhisarai (Mahila) P.S. Case No. 10 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
