JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 399/420 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused who was apprehended on the spot with arms and ammunition. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel appearing for the State opposes the prayer for bail on the ground that petitioner's name has figured during course of investigation in confessional statement of coaccused who was apprehended on the spot with arms and ammunition. Besides this, petitioner has got criminal antecedent

Patna High Court CR. MISC. No.44685 of 2022(2) dt.05-12-2022 2/2 as he is already accused in four other criminal cases. Considering the nature of allegation and the criminal antecedents of the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
