The petitioners apprehend their arrest in Garkha P.S. Case No. 190 of 2016 registered under Sections 302 and 201/34 of the Indian Penal Code.
The informant alleged that his sister was married to Mahendra Mahto in the year 2007, but her husband and his family members started demanding dowry and ultimately, they killed his sister.
Learned counsel for the petitioners submits that the petitioners are co-sharer of the husband of the deceased. They never demanded any dowry nor tortured the deceased. The
Patna High Court Cr.Misc. No.48376 of 2016 (2) dt.15-12-2016 2/2 marriage was solemnized in the year 2007. The deceased died in the year 2016 and the petitioners have no concern with the family of the husband of the deceased.
Considering the facts aforesaid that the petitioners are simply neighbours of the deceased, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran, in connection with Garkha P.S. Case No. 190 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
