This application has been filed against the impugned order dated 10.06.2013 & 03.07.2013 passed by Sub Judge-II, Kishanganj in Title Eviction suit no. 2/2009, by which the prayer made on behalf of the defendant-petitioner to implead Jamini Kumar Sinha as party in the suit has been turned down. From perusal of the impugned order, it appears that the evidence of the plaintiff has already been closed and the part evidence on behalf of defendant has also been adduced. The learned court below has also taken into notice the fact that the prayer made by defendant in the suit to implead a person as a party cannot be allowed.
