Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. The FIR of occurrence of robbery is against unknown.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 05.12.2016. He was never put on TIP nor anything has been recovered from his possession. He further submits that earlier the petitioner had moved this Court for bail in Cr. Misc. No. 10997 of 2017. However, prayer for bail was refused on 16.05.2017 only for the reason that the petitioner had not disclosed his criminal antecedent. Though the petitioner was accused in one more case.

No.60740 of 2017 (2) dt.03-01-2018 2/2 Considering the fact that there is no substantial material against the petitioner and the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gaighat Police Station Case No. 201 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
