The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 323, 448, 324, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that due to land dispute the accused persons abused informant and his family members and prevented them from going on the land. They assaulted informant and family members. They also misbehaved with female members. It is submitted on behalf of the petitioner that he has got no criminal antecedent. There is no allegation of tampering of witnesses against petitioner. Petitioner has falsely been implicated in the present case. No specific allegation is made against petitioner. General and omnibus allegation has been made. Specific allegation has been made against Tahir, Dabir, Akhtar and Meraj. It is a case and counter case between the parties. One person is said to have died in the accused side. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Ramnagar P.S. Case no. 193 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
