The petitioner apprehends his arrest in connection with Danapur P.S. Case no. 429 of 2018, registered under Sections 498(A), 406 and 497/34 of the Indian Penal Code and Section 3 / 4 of Dowry Prohibition Act.

The accusation is of torturing of the complainant due to non-fulfillment of demand of cash of Rs. 25 Lakhs for purchase of flat and removing her from matrimonial house. Learned counsel for the petitioner submits that, in fact, due to white complexion of the petitioner, O.P. No.2, who is wife of petitioner does not want to live with the petitioner. The petitioner had filed the Divorce Case No. 04 of 2018 in the

Patna High Court CR. MISC. No.62671 of 2018(8) dt.21-08-2019 2/2 Court of Principal Judge, Family Court, Chandauli on 03.01.2018. Thereafter, the informant/O.P. No.2 filed the present case on 29.06.2018 after filing the present application on the initiation of the informant, petitioner filed the application to withdraw the aforesaid Divorce Case and the said case was also withdraw and the petitioner took the O.P. No.2 at his house, but, she again left her matrimonial house. On the other hand, learned counsel appearing on behalf of O.P. No.2 submits that while the informant No. 2 was taken by the petitioner at her matrimonial house, but, again, she was tortured and removed from matrimonial house.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Danapur in connection with Danapur P.S. Case No. 429 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
