2. The petitioner has preferred this application in connection with Baghaila P.S. Case No. 03 of 2022 dated 10.01.2022, registered for the offences punishable under Sections 366A, 120B, 506 & 504 of the Indian Penal Code under section 3(2) (v) (a) SC/ST Act and under section 12 of the POCSO Act.

3. As per the prosecution case, the petitioner is alleged to have kidnapped the minor daughter of the informant on the pretext of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no criminal antecedent mentioned

Patna High Court CR. MISC. No.45976 of 2023(5) dt.17-02-2024 2/2 in para 3 of the bail application. Learned counsel further submits that there was love affair between the accusedpetitioner and the victim girl. The statement under section 164 Cr.P.C. has not supported the prosecution case and she has fled away of her sweet will.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the nature of allegations leveled against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sasaram, Rohtas in connection with Baghaila P.S. Case No. 03 of 2022 subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
