The petitioner apprehends his arrest in Bidupur P.S. case No.148 of 2016 under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that while he was feeding his cattle the petitioner, Munna Baitha, came and began to abuse the informant. The petitioner pushed the informant and started fleeing away with wooden box and when the informant caught the petitioner the petitioner assaulted him with sickle on his head. Other accused persons also assaulted the wife of informant. It is submitted that there is land dispute between the parties but from perusal of the case diary, it appears that the informant got one lacerated wound on his head and opinion with

Patna High Court Cr.Misc. No.39978 of 2016 (4) dt.10-11-2016 2/2 regard to nature of injury was kept reserved. The petitioner is author of the injury caused by sickle on the head of informant. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
