In this case, the petitioner is seeking anticipatory bail in connection with Rohtas P.S. Case No. 83 of 2019, registered for the offence under Section 366/34 of the Indian Penal Code.

Allegation has been made that the daughter of the informant had gone to bring the book from her friend, but she did not return. When the informant came there, it was informed that she has gone to her Phupha's house, later on, it transpired that Nitesh Kumar, Karan Kumar and Akash Kumar, took away the daughter of the informant for the purposes of marriage. The victim-girl in her statement recorded under Section 164 of the Cr.P.C. has not taken the name of any person. Learned counsel for the petitioner submits that it is

Patna High Court CR. MISC. No.40011 of 2019(2) dt.01-07-2019 2/2 a story in which Nitesh Kumar and the victim-girl had fallen in love and they were found roaming together. He further submits that the victim-girl was under the influence of said Nitesh Kumar.

Looking to the aforesaid facts, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Dehri, District- Rohtas, in connection with Rohtas P.S. Case no. 83 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation.
