JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioner seeks bail in connection with Industrial P. S. Case No. 91 of 2018 registered under Sections 307,323,341,504 and 506 of the Indian penal Code. Allegation against the petitioner is of assaulting the informant and also caused injury on the ear of the informant . Submission of learned counsel for the petitioner is that evidences of witnesses in para 26 and 27 of the case diary disclosed that there was scuffle and the informant fell down due to which he received injuries; moreover, petitioner is in custody since 14.07.2018.
Heard learned APP as well as learned counsel for the informant, who oppose the prayer of bail stating that injuries are grievous in nature and the wife of the petitioner was not living with him rather she was living with the informant and as such
Patna High Court Cr.Misc. No.61770 of 2018(5) dt.06-12-2018 2/2 petitioner assaulted the informant causing injury to him. Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Industrial P.S. Case No. 91 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
