JUSTICE SANJAY KUMAR SINGH ) 28-07-2026 Instant Criminal Appeal, arising out of judgment of conviction dated 30.08.2005 and order of sentence dated 31.08.2005 passed by the learned Additional Sessions Judge, Fast Track Court-2, Jamui, in Sessions Trial No.572 of 2003 (Khaira PS case no.50 of 2001) is listed for hearing.
2. Despite repeated calls, none appears on behalf of the appellant, whereas Mr. Dilip Kumar Sinha, learned Additional Public Prosecutor for the State is present.
3. Perusal of record shows that vide letter dated 02.07.2026 of Assistant Registrar, Criminal Appeal Section of this Court, a living status report of accused appellant-Krishna Manjhi, was called for. In response thereto, Superintendent of Police, Jamui, submitted a report dated 21.07.2026 based on the
Patna High Court CR. APP (DB) No.1385 of 2008(8) dt.28-07-2026 2/2 information furnished by the Station House Officer, Charkapathar Police Station, Jamui, apprising this Court that the sole appellant namely, Krishna Manjhi has died on 05.08.2020 during pendency of this Criminal Appeal. The Death Certificate dated 20.07.2026 issued by the Sarpanch, Gram Kutchery, Keshofarka, Block-Sono, District-Jamui, is also enclosed along with the said report.
4. In view of the above, the instant Criminal Appeal filed by appellant-Krishna Manjhi stands abated.
