JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 The petitioner being husband of the complainant is apprehending his arrest in a complaint case filed with accusation under Sections 323, 341, 379, 498A, 504 of the Indian Penal Code, wherein processes has been issued after cognizance being taken.

It is submitted by learned counsel for the petitioner that petitioner is still ready to keep the complainant as wife with dignity and honour. A statement to that effect has been made in para 10 of the petition which reads as follows:- "That the petitioner is still ready to keep the complainant as wife with full respect and dignity"

Considering the fact that summons have been issued, let learned Court below consider the prayer for regular bail of the petitioner, keeping in view of the ratio laid

Patna High Court Cr.Misc. No.53257 of 2015 (2) dt.23-11-2015 2/2 down in the case of Salim Ansari @ Md. Salim Ansari & Ors versus State of Bihar & Ors reported in 2015(3) BLJ(PHC24), if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 5889 of 2014, pending in the Court of learned Chief Judicial Magistrate, Madhubani. It is expected from the learned Court below to dispose of the application preferably on the same day.

Accordingly the application is disposed of.
