2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
3. As per prosecution case, 45 litres country made liquor was recovered from the motorcycle of the petitioner.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner and he has falsely been implicated in this case merely on suspicion. The alleged illicit liquor has been recovered from the motorcycle of the petitioner; however, it is submitted that the said motorcycle
Patna High Court CR. MISC. No.41774 of 2025(2) dt.31-07-2025 2/2 had been taken by his neighbour for personal use and the petitioner was not aware of the fact that it will be used for illegal work. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the fact that huge quantity of illicit liquor was recovered from the vehicle of which this petitioner is registered owner, the prayer for anticipatory bail to the petitioner is rejected.
