The petitioner seeks bail in connection with Manjhagarh P.S. Case no. 41 of 2017 registered for the offence punishable under Section 414/34 of the Indian Penal Code. Stolen motorcycle is said to have been recovered and seized from the possession of the petitioner. It is submitted by the learned counsel for the petitioner that the petitioner has no concern with the said occurrence and the said motorcycle. As a matter of fact, seeing the police party, the real culprit managed to escape and as the petitioner was regressing to his house from the market located in vicinity of the place of occurrence, he was arrested by the police and roped in this case to showcase its efficiency. Patna High Court Cr.Misc. No.50450 of 2017 (2) dt.18-10-2017 2/2 has also surfaced in his confessional statement recorded before the police which has no evidentiary value in the eye of law. The petitioner has been languishing in custody since 21.03.2017 and the charge sheet in the case has been submitted. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj in connection with Manjhagarh P.S.
