The case arises out of Hajipur Sadar P.S. Case No.648 of 2021 lodged on 17.07.2021 under Sections 20, 22, 23, 24, 27 and 29 of the N.D.P.S. Act.

As per the prosecution story when the police patrol party reached the village-Manua near the poultry farm of Suraj Patel, two persons tried to escape from that place leaving a motorcycle. They were apprehended who disclosed their names as Suraj Patel and Sanjay Kumar Paswan (the petitioner herein). The plastic bag that was hanging on the motorcyle was checked and the police states that 35.200 Kgs. of 'Ganja' was recovered from him.

Considering the quantity of the material that has been recovered/seized by the police from amongst other the petitioner herein, this Court is not inclined to grant the privilege of bail to
