Petitioner apprehends his arrest in Bidupur P.S. Case No.77 of 2019, registered under Section 33 of the Bihar Prohibition and Excise Act.

The gist of the allegation is that one motorcyclist was coming and on being signaled to stop, the motorcyclist fled away leaving the motorcycle on the spot. On search, liquor made of mahua was recovered from a gallon kept in a bag tied with the motorcycle.

Learned counsel for the petitioner submits that petitioner is the owner of the motorcycle. The petitioner was not carrying liquor. Some villager has taken the motorcycle and petitioner has been made accused only because the owner book of the motorcycle stands in the name of the petitioner.

No.40133 of 2019(2) dt.01-07-2019 2/2 Taking into consideration the facts, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-2-cumSpecial Judge, Excise, Vaishali at Hajipur in connection with Bidupur P.S. Case No.77 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
