JUSTICE BIRENDRA KUMAR ORAL ORDER 09-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Jehanabad P.S. Case No.297 of 2014, a case under Section 364/34 of the Indian Penal Code. Subsequently, the offences under Sections 302/201/120B of the Indian Penal Code were also added. The F.I.R. does not reveal that there is any eyewitness of the occurrence. However, circumstantial evidence is there against co-accused Sangita and Munna. In the confessional statement Sangita stated that she and Munna had committed the murder of the victim.

Considering the fact that only material against the petitioner is confession of co-accused before the police, which is

Case No.297 of 2014, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
