JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Beldaur P.S. Case No. 207 of 2017 instituted for the offences under Sections 30 and 32 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 52 litres of illicit liquor from a Scorpio vehicle.

The learned counsel for the petitioners submits that neither the liquor was recovered from the conscious possession of the petitioners nor they are the owner or the driver of the said vehicle. As far as petitioner no. 1 is concerned, three cases are pending against him out of which he is on bail in two cases. As

Considering the nature of accusation and the period of custody already undergone, I direct the petitioners named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3rd, Khagaria in connection with Beldaur P.S.
