Petitioner, who is in custody, seeks bail in connection with Bochahan P.S. Case No. 287 of 2017 registered for the offence punishable under Sections 395 of the Indian Penal Code.
Allegation against petitioner is that petitioner alongwith other co-accused looted the pick-up van loaded with the good and on the point of gun looted away cash Rs. 10,000/-, mobile and driving license.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that seizure list does not bear the
Patna High Court Cr.Misc. No.61817 of 2018(3) dt.05-11-2018 2/2 signature of petitioner and nothing has been recovered from his possession except his own mobile and PAN card. Petitioner has been apprehended only on suspicion and he has not been put on T.I.P. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 25.12.2017. Considering the nature of allegation against petitioner, I am not inclined to grant bail to the petitioner at this stage. Accordingly the prayer for bail is rejected. However, petitioner may renew his prayer for bail after framing of charge.
