Petitioner nos.2 and 3 apprehend their arrest in Kadwa P.S. Case No.288 of 2019 registered under Sections 304(B), 201, 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners have committed no offence and have falsely been implicated in this case. It is further submitted that the information for lodging the F.I.R. was given by the informant
Patna High Court CR. MISC. No.2691 of 2021(5) dt.18-01-2022 2/2 (father of the deceased) at Rudrapur P.S. after delay of nine days of the alleged occurrence. In this regard, petitioner no.3 wrote a petition to the Officer-in-Charge, Kadwa P.S., which was entertained by the police as is evident from Annexure 2. No specific allegation is made against the petitioners. Petitioner no.2 Punita Kumari @ Punita Devi is sister-in-law (nanad) of the deceased and petitioner no.3 Dinesh Kumar @ Dinesh Lal Das is husband of the deceased.
Having considered the above facts and circumstances of the case, petitioner nos.2 and 3, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing personal bonds to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No.288 of 2019 corresponding to G.R. No.5551 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
