JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-01-2017 The learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition with respect to petitioner No.3, Ram Niwas Ram.
Accordingly, the anticipatory bail petition of petitioner No.3 is dismissed as withdrawn.
Heard both sides.
The petitioners apprehend their arrest in Koran Sarai P.S. case No. 65 of 2016 under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that he saw that more than 50 persons were harvesting his crops and when he raised alarm Dev
Patna High Court Cr.Misc. No.1490 of 2017 (2) dt.17-01-2017 2/2 Muni Ram caught him and Ram Niwas Ram assaulted him with Farsa on his head. Other accused persons also assaulted him with stick.
The learned counsel for the petitioners submits that there is case and counter case and from the side of petitioners Koran Sarai P.S. case No. 66 of 2016 was registered. The petitioners are bonafide purchasers of the land. A proceeding under Section 144 of the Cr. P. C. is pending between the parties. Considering the facts aforesaid and the fact that no specific allegation is made against the petitioners, the above named petitioners Nos. 1 to 2 and 4 to 11, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Buxar in Koran Sarai P.S. Case No. 65 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
