Mr. Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 04-03-2022 Heard the parties through video conferencing. The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the three accused persons namely Chandra Chaudhary, Md. Sikandar and Md. Humayun stabbed the son of the informant who was sleeping and he died on the spot. The occurrence was seen by the elder brother of the informant. The informant further states that a few days ago her son had protested to the petitioner who was carrying on prostitution in the house as a result of which an attempt had been made on the life of the informant's son. The informant states that he is convinced that it is as a result of conspiracy in which the petitioner is involved that his son had been killed.

Patna High Court CR. MISC. No.52565 of 2021(2) dt.04-03-2022 2/2 It is submitted by learned counsel for the petitioner that the petitioner who is a lady has been falsely implicated in the case. Referring to the order of the learned Court below wherein the contents of the case diary have been dealt with in detail it is submitted that the suspicion raised by the informant are unfounded. In any case in the FIR there is specific allegation against the three named co-accused. No overt act has been alleged against this petitioner who is in custody since 16.5.2021 and has no criminal antecedent.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Mufassil P.S. Case no. 276 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
