2. The petitioner seeks regular bail in connection with Neemchak Bathani P.S. Case No. 239 of 2024 registered for the offence under Sections 126(2), 115(2), 109, 329(4), 324(4), 75, 303(2), 352, 351(2), 351(3), 3(5) of the Indian Penal Code.
3. As per the prosecution case, the petitioner is said to have assaulted the victim.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 18.05.2025. He further submits that during the investigation, no injury has been found upon the informant who is said to have been assaulted by the petitioner.
5. Learned A.P.P. appearing for the State has
Patna High Court CR. MISC. No.43832 of 2025(2) dt.16-07-2025 2/2 vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya/concerned Court below in connection with Neemchak Bathani P.S. Case No. 239 of 2024.
