Petitioner seeks bail in Special Case No.383 of 2018 arising out of Saharsa Sadar P.S. Case No.862 of 2018 instituted for the offence under Section(s) 30(a), 38(i), 41(i) of Bihar Prohibition and Excise Act, 2016.

It is alleged that total 18 litres foreign liquor has been recovered from the land in front of house of the petitioner. Seizure list is part of the First Information Report, which does not bear signature of the petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 16.08.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.68705 of 2018(2) dt.29-11-2018 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Saharsa, in connection with Special Case No.383 of 2018 arising out of Saharsa Sadar P.S. Case No.862 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
