The petitioner seeks pre-arrest bail in Mahnar P.S. Case No.179 of 2018 registered for the offences under Sections 354, 354(A), 354(B) of I.P.C. and Sections 8 and 12 of Prevention of Children from Sexual Offences Act. Accusation is that on 26.07.2018 at 12 O' clock while the informant was going to call her mother who was working in the field, in the way the petitioner caught hold of her forcibly and tried to pull her upon which the informant made request but her request was turned down then she raised hullah and on seeing the villagers the petitioner fled away. Learned counsel appearing on behalf of the petitioner submits that, the petitioner and the informant are co-villagers

Patna High Court Cr.Misc. No.61046 of 2018(5) dt.13-02-2019 2/2 and due to land dispute in the family between the petitioner and the informant the present case has been lodged. In fact, Raghubir Singh, grand father of the petitioner, had purchased R.S.Plot No.1781whereas father of the informant had also purchased a piece of land bearing R.S.Plot No.1782, 1783 from Ram Kishun Sah adjacent to the land of the petitioner due to which dispute arose on the point of demarcation. The petitioner is student and has clean antecedent.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1, Vaishali at Hajipur, in Mahnar P.S.Case No.179 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
