The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354, 379, 504/34 of the Indian Penal Code. It is alleged that petitioner no.1 Jawala Prasad came in drunken condition caught hold the informant and started pulled her 'saree'. On alarm being raised she was pushed on the ground when her elder son Bittu Kumar and husband Shailendra Prasad came to rescue then Shardanand Patel @ Baua inflicted injury with iron rod on the forehead of the son of the informant. It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.54485 of 2015 (2) dt.02-12-2015 2/2 that no injury was caused to the informant when injury of the informant's son has been found to be simple in nature and at earlier point of time petitioners' side lodged Pakribarawan P.S. Case No.138 of 2015.
Considering the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Pakribrawan P.S. Case No.139 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
