The petitioner seeks bail in connection with Halsi (Ramgarh Chowk) P.S. Case No. 129 of 2020 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The prosecution case, in brief, is that informant Rajendra Prasad submitted written report tot he S.H.O. Halsi (Ramgarh Chowk) P.S. stating therein that daughter of the informant namely Archana Kumari was married with Manish Kumar (petitioner) on 09.02.2014 and after laps of some months of her marriage, her husband started to assault and asked to demand money from her father, she conveyed the said matter to

It is further stated that Kumari Simpal Sinha (sister-in-law) and one Yogendra Mandal used to help Manish Kumar for the said act and Manish Kumar (petitioner) had illicit relation with another girl. It is further stated that Kumari Simpal Sinha and her lover Yogendra Mandal used to came her house and tortured his daughter with the help of Manish Kumar. His daughter protested Kumari Simpal Sinha and Yogendra Mandal to came her house as a result of which on 26.06.2020, Manish Kumar, Yogendra Mandal and Kumari Simpal Sinha strangulated his daughter.

Learned counsel for the petitioner submits that the petitioner is in jail custody since 29.06.2020. The doctor as found ligature mark on the front part of neck of the deceased and opined that the cause of death is asphyxia due to strangulation. The petitioner is said to be the husband of the deceased.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on bail.
