JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Begusarai Town P.S.Case No. 135 of 2017 registered under Sections 302/34 of the Indian penal Code and Section 27 of the Arms Act.
Allegation in brief is that while the deceased was celebrating birthday in his shop, some accused persons entered into and shot him dead and the miscreants were captured in the C.C.T.V. installed in the shop.
Submission is that petitioners have been falsely implicated and there is only one fire arm injury caused to the deceased and subsequently, as disclosed by a witness, deceased was shot by Prince Kumar, another co-accused, and in para-59 of the case diary, it is categorically mentioned that footage of C.C.T.V.
Patna High Court Cr.Misc. No.57706 of 2017 (3) dt.19-01-2018 2/2 installed in the shop was not handed over to the Investigating Agency by informant and the police has submitted charge sheet in this case though the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Sanjeev Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 135 of 2017, with condition that one of the bailor must be his family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
