JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2018 On different dates this writ petition was listed for admission. From the order sheet it appears that on 15.10.2011 the writ petition was dismissed for non-prosecution. The writ petition was subsequently restored vide order dated 12.2.2018 passed in MJC No. 1959 of 2015 and thereafter on numerous occasions when the case was listed, no one had appeared. Under the compelling circumstances, the Court does not find any justification to keep this writ petition pending, particularly in view of the fact that the petitioner is aggrieved by the order of the District Teachers Employment Appellate

Patna High Court CWJC No.3171 of 2011(3) dt.06-07-2018 2/2 Authority, Jamui in case No. 350 of 2010 and now there is statutory remedy by way of appeal before the State Appellate Authority.

In case the petitioner has any subsisting grievance, he may approach the State Appellate Authority within a period of one month from today and in case such appeal is filed, the appellate authority shall decide the appeal after condoning the delay having regard to the fact that this writ petition has remained pending before this Court for more than 7 years. With the aforesaid, the writ petition stands disposed of.
