2. The petitioner apprehends his arrest in a case registered for the offence under Sections 274/275/317(5)/3(5)of the B.N.S. and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 1440 liters of Nepali country-made liquor has been recovered from seized vehicle.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner and has been implicated in this case only on suspicion. The petitioner is alleged to have fled away from the spot. The petitioner is not the owner of the vehicle. The petitioner has one criminal antecedent in which he is on bail.

5. Learned A.P.P. for the State has opposed the bail

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge II cum Special Judge, Excise Act, Madhubani, in connection with Jaynagar P.S. Case No. 119/2025, subject to condition as laid down under Section 482 of the BNSS, 2023.
