This is an application for bail in connection with Shastrinagar P.S. Case No. 100 of 2017, registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act. Prosecution case as per FIR is that police on information of committing dacoity raided the place and from the possession of petitioner one country made pistil and five cartridges were recovered.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 21.2.2017. Further submission is that though he is accused in three other cases but he is on bail in those cases. Heard learned APP also.

Having heard both sides and in view of facts and

No.49407 of 2017 (3) dt.09-11-2017 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge-IV, Patna, in connection with Shastrinagar P.S.Case No. 100 of 2017, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month at least for one year, so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.

Let this order be communicated to the Sr.Superintendent of Police, Patna for its compliance. (Vinod Kumar Sinha, J) spal/- U
