JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1197C of 2017, registered for the offences punishable under Sections 498(A), 406, 323, 379, 506, 504, 34 of the Indian Penal Code.

This case is under Section 498A of the I.P.C. Petitioner happens to be husband of the complainant with an allegation of demand of dowry and for that subjecting the complainant to torture and cruelty. There is also allegation against the father-in-law of the complainant trying to outrage her modesty.

Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with full dignity and care. Earlier in the Court

Patna High Court CR. MISC. No.42357 of 2019(3) dt.11-09-2019 2/2 below notice was issued to the complainant but she did not appear.

In this case also notice was issued to opposite party no.2, it appears from perusal of the record that opposite party no.2 has appeared through filing Vakalatnama but nobody appeared on behalf of the opposite party no.2. Heard learned A.P.P. also.

In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Addl. Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Complaint Case No. 1197C of 2017 subject to the condition as laid down under Section 438

(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
