Petitioner being husband of the victim is facing prosecution under Sections 498, 304B, 201 and 34 of the Indian Penal Code vide Nardiganj P.S. Case No. 08 of 2014 for having committed murder of his wife for want of non-fulfilment of demand of dowry. The occurrence took place within seven years of marriage at Sasural.

Contention of the petitioner is that the victim committed suicide due to family feud as she was fade up with the birth of female child. It is stated that one accused of this case namely Munna Yadav has been granted anticipatory bail. From the order of the learned Sessions Judge, it appears that in course of investigation, witnesses have supported the

Patna High Court Cr.Misc. No.37777 of 2016 (2) dt.18-10-2016 2/2 prosecution case.

In my view, it is not a fit case for grant of anticipatory bail to the petitioner. Prayer is rejected.
