JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Kargahar (Barhari) PS Case No. 248 of 2017 registered under Sections 366A/34 of the IPC.

The allegation in brief is that he informant's daughter was enticed away by the petitioner and one another accomplice. The girl was recovered and she stated that she was forcibly taken away by the petitioner.

Learned Counsel for the petitioner submits that it was a case of elopement as there was some affair between the petitioner and the informant's daughter, she was major and the medical report shows her age between 16 - 17 years.

Having considered the said facts and circumstances, the petitioner, namely, Minaj Alam is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Rohtas at Sasaram in connection with Kargahar (Barhari) PS Case No. 248 of 2017.
