The petitioner seeks bail in anticipation of his arrest in connection with Buniyadganj P.S. Case No. 191 of 2017 instituted for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
03 litres of country made liquor and 30 Kgs of mahua flower is said to have been recovered from a field which according to the petitioner does not belong to him. The petitioner is sought to be prosecuted in this case only on assumption.
The petitioner does not have criminal antecedents. It has further been submitted that the recovery is from
Patna High Court CR. MISC. No.39173 of 2020(2) dt.04-05-2021 2/2 an open space which is accessible to all & sundry. Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of receipt / production of a copy of this order on furnishing bail bonds in the sum of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Buniyadganj P.S. Case No. 191 of 2017 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
