The petitioner is in custody in connection with Khizarsarai P.S. Case No.152 of 2017, a case under Sections 147/149/341/323/504/506/326/307/509/379 of the Indian Penal Code.
As per F.I.R. the petitioner allegedly caused injury at the hand of Nityanand Kumar and at the back of the informant. There is no allegation of repetition of blow nor the prosecution allegation is consistent with the medical report. The injury report does not reveal that the informant had sustained any injury at the back rather; one incised wound was found over occipital region.
Patna High Court Cr.Misc. No.57184 of 2017 (3) dt.05-01-2018 P2/ Learned counsel for the informant opposed the prayer for bail.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khizarsarai P.S. Case No.152 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
