This application is for grant of regular bail in connection with Buniyadganj P.S.Case no.139 of 2015 for the offences punishable under Sections 341, 307, 302, 387 and 34 of the Indian Penal Code.
Allegation against the petitioner is of firing on the deceased causing his death.
Submission of the learned counsel for the petitioner is that the allegation has not been corroborated by the evidence of the witnesses, bullet and arms were recovered and later on witnesses have stated about the fact that the petitioner was carrying the same. Now he is in custody for five months. Heard learned A.P.P. also, who has opposed the
Patna High Court Cr.Misc. No.53207 of 2017 (3) dt.22-11-2017 2/2 prayer for bail stating that there is direct allegation against the petitioner and secondly the case is of the year, 2015. He is named in the FIR. Still he has appeared after two years in this case. Having heard both sides and in view of direct allegation against the petitioner and also his conduct, I am not inclined to grant bail to the petitioner.
With the aforesaid observation, this application is dismissed.
