Shailendra Kumar Singh for the Corporation.

The application seeks modification in the order dated 16.08.2016 passed in Cr. Misc. No. 31045 of 2016 whereunder upon surrender, the petitioner was directed to be released provisionally on bail for a period of one month whereafter he was permitted to demonstrate before the Court that all the amount due against the petitioner has either been paid or adjusted by the Corporation. It is stated that some of the dues against which the petitioner sought adjustment is still under consideration of the Corporation.

Mr. Shailendra Kumar Singh has not disputed the aforesaid contention.

Considering the above, this Court is persuaded to

Patna High Court Cr.Misc. No.46915 of 2016 (2) dt.26-10-2016 2/2 allow the application and modify the operative part of the order dated 16.08.2016 passed in Cr Misc. 31045 of 2016. The time allowed for the provisional bail in the said order is modified to three months from the grant thereof. Said modification has been allowed on the submission of the petitioner that if the adjustment claimed by the petitioner is not granted, the petitioner would deposit the remaining amount with the Corporation subject to result of the case and produce the relevant papers/receipt/document before the Court whereafter only the Court below will confirm the provisional bail of the petitioner.
