The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,324 and 307/34 of the Indian Penal Code.

It is alleged that the petitioner assaulted with knife just below the eye of the informant.

It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. Though incised injury has been found on the right side of the face near the eye but it has been found to be simple in nature.

Patna High Court Cr.Misc. No.54674 of 2015 (2) dt.03-12-2015 2/2 that the injury has been caused on the vital part of body of the informant which shows the intention of the petitioner. Be that as it may, the counter version of the occurrence constitutes ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Jamo Bazar (Maharajganj) P.S. Case no. 81 of 2015 pending in the court of learned JM Ist Class, Siwan.

This application is disposed of with the aforesaid observation/direction.
